. -~ <br />PORTIONS OF THE HAUL ROAD CORRIDOR, PURSUANT TO RULE 4.15.7(2)(d)(v), <br />INCLUDING ALL APPLICABLE SUPPORTING DOCUMENTATION (OR REFERENCE <br />TO SUCH DOCUMENTATION IF PREVIOUSLY SUBMITTED TO THE DIVISION). <br />FURTHER DATA COLLECTION PROPOSED (IF ANY) TO ESTABLISH THE HISTORIC <br />RECORD STANDARD WILL ALSO BE DEFINED IN THE APPLICATION. <br />ALTERNATIVELY, THE APPLICATION WILL PROVIDE A PLAN AND APPLICABLE <br />SUPPORTING DOCUMENTATION FOR HERBACEOUS PRODUCTION SUCCESS <br />COMPARISON THAT WILL COMPLY WITH RULES 4.15.7(2)(d)(i) OR (iv). <br />STATUS: Complied with 04/12/2007. Stipulation No. 18 has been satisfied by approval of <br />TR-31. <br />SECTION IV -MIDTERM ADEQUACY QUESTIONS <br />The Division does not have any adequacy questions or comments regarding this Midterm <br />Review. <br />SECTION V -PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Division previously granted variances from contemporaneous reclamation requirements for <br />portions of the Yoast Mine. Changes to the reclamation schedule for various areas at the Yoast <br />Mine were approved with Technical Revision No. 20. Pursuant to Rule 4.14.1(1)(c), the <br />Division approved a variance from the requirements that rough backfilling and grading be <br />conducted within 180 days following coal removal. This variance applied to the North Area pit <br />and to the northern portion of the Yoast South Area pit. Mining has been completed at the Yoast <br />Mine and the variances are no longer necessary. The entire Yoast Mine including the North <br />Area pit and South Area pits have been reclaimed. <br />SECTION VI -BONDING SUMMARY <br />The Division holds an approved bond on behalf of the permittee for the Yoast Mine. The <br />bond is a Corporate Surety from Seaboard Surety Company, Bond No. 329873, in the <br />amount of $5,200,000.00. Pursuant to Rule 3.02.2(4), the Division is conducting a review of <br />the Yoast Mine reclamation liability, in association with the midterm permit review. <br />As a component of the review, the Division will prepare an updated reclamation cost <br />estimate for the 2008 Midterm Review for the Yoast mine. If the updated reclamation cost <br />estimate indicates that the reclamation Lability exceeds the current bond amount held, the <br />operator will be required to provide the necessary additional bond. The updated cost <br />estimate will be sent to SCC under separate cover, as soon as it is completed. <br />4 <br />
