(a) The institution issuing the trust or financial instrument files for <br />bankruptcy; or <br />(b) The authority of the trustee institution to act as trustee, or the authority of <br />the institution issuing the financial instrument, is suspended or revoked. <br />3. Cancellation of Demonstration by Financial Institution. The permittee must <br />submit an alternative demonstration of financial responsibility acceptable to the <br />Director, within sixty (60) days ,after the institution issuing the trust or financial <br />instrument serves 120-day notice to the EPA of their intent to cancel the trust or <br />financial instrument. <br />G. TEMPORARY SUSPENSION PLAN <br />The permittee may temporarily or intermittently suspend mining operations and <br />underground injection in some or all wells. During periods of temporary suspension, the <br />permittee shall not actively mine by underground injection of fluids and shall operate its <br />facility in accordance with the following requirements. <br />At the time a well is placed in temporary suspension status, there shall be no injection <br />into that well. Injection may resume only after a mechanical integrity test has <br />demonstrated mechanical integrity and written permission from the Director is received. <br />In order to assure the possible restart of well field operations at a future time, the wells <br />will be placed in a state of temporary suspension using the following procedures: <br />1. Notification <br />a. The permittee shall give advance written notice to the Director, as soon as <br />possible, prior to commencing temporary suspension of well operations. <br />Notice shall include identification of all wells to be placed in temporary <br />suspension status. <br />b. The permittee shall not be deemed to be operating in a temporary <br />suspension mode until 5 business days after the date that notification of <br />temporary suspension is sent to the Director. <br />In addition to receiving written authorization to resume injection as <br />specified in II(G) above, the permittee shall give written notice to the <br />Director within 5 business days of actually resuming well operations and <br />shall identify all wells returned to service. For an~ well that has suspended <br />aerations for more than two years the permittee shall notify the Director <br />30 days prior to resuming operation of the well. <br />2.
