San Luis Project <br />CDMG Annual Report <br />March 23, 2008 <br />Page 5 <br />During 2007, BMRI withdrew one Permit Amendment (Amendment #2) and submitted one <br />Permit Amendment (Amendment #3) to the Division. The Permit Amendment #2 application <br />was with drawn to revise the application to incorporate public comments or suggestions received <br />from the public comment period. These Permit Amendment applications proposed for the <br />construction of a water conveyance pipeline from the West Pit pumping wells to the adjoining <br />Newmont Reality Company ranch. In addition, the Amendment #3 application proposed <br />construction of two lined ponds in the West Pit area for the winter season storage of water from <br />the West Pit. The proposed construction would be for the long-term use of the West Pit water at <br />the ranch as crop irrigation water. A temporary substitute supply plan was filed with the <br />Colorado Department of Natural Resources and subsequent a filing concerning the transfer or use <br />of water rights with the Water Court. <br />Attached are the Annual Fee and Report Request and the $1,000 annual fee payment. <br />Should any questions concerning the above reported activities arise, please feel free to contact <br />either Mr. Julio Madrid or myself. <br />S' cerely, <br />Bill Lyl <br />Director of Env.
