The Conceptual Engineering Designs provides pipe depth and <br />the Reclamation Map shows approximate location. If more detail is necessary to calculate the <br />State 's reclamation bond, please .sped. <br />E) "It is the understanding of the Division, the maximum area that will be disturbed at any <br />given time will not exceed 63 acres. Depth of mining will not exceed 40 feet with an average <br />depth being 33 feet. Please verify?" <br />Response: We are not clear as to what the Division considers "verification "? The Appl ication <br />Form requires the Applicant to initial statements in the application form that all information <br />contained in the Application and its exhibits are true and correct to the best of the Applicants <br />knowledge. The mine plan exhibit states the Applicant's excavation intentions. In addition, <br />Section (~(iiJ of the Mine Plan Exhibit describes the extent of the resouree. If significant <br />changes to the mine plan should occur, the Applicant will submit the appropriate permit <br />revision. <br />F) "...the operator refers in several areas of the applicatian the probable use of <br />dredging....one assumes dry mining, which method of mining will be implemented... " <br />Response: We reviewed the Application several times in an attempt to find reference to <br />dredging. Please sped where those references are. Our review only referenced dry mining <br />after dewatering'? <br />Adequacy Items III A-D: <br />A) "In order for the Division to calculate the required warranty, a detailed design, <br />construction and QA/QC for the proposed method is required....the slurry wall design, <br />construction and QA/QC has to be approved by the State Engineer's Office." <br />Response: Please .see the Response to item II-B above. In order to resolve this item, it may be <br />appropriate for the Division and the Applicant's consultant and engineering consultant to meet. <br />B) "The applicant states `a comparison of the proposed post mining land use to other land <br />uses in the vicinity and to adopted state and local land use programs. Where the post mining <br />land use is for commercial purposes, appropriate evidence supporting such reasonable <br />assurances, shall be submitted, if not a plan for revegetation shall be submitted.' The first <br />sentence didn't make sense. If the intent is to have areas not covered by the lake as post mining <br />land use to be other than the current Range/Wild Life Habitat, the applicant will need to submit a <br />revision to the permit with proof from the county that the area has been designated as proposed. <br />Until such time the Division will base all post mining land use warranty calculations as such." <br />Response: The sentence referred to in the above adequacy question is taken from the Division's <br />regulations. We cannot respond since we did not write the sentence. <br />Affected areas not in reservoir, reservoir support facilities to include roads, will be reclaimed so <br />as to provide for site stability.
