III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />18 March 2008 C~ <br />Pg 1 /4 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection andl the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br />The inspection was conducted on 18 March 2008. Tony Tennyson and Ryan <br />Pawlowski of CCC accompanied me on the inspection. The mine was actively <br />mining coal and hauling coal to the loadout at the time of the inspection. The <br />weather warm (raid 40's) and sunny and the ground was covered with snow. The <br />snow has meltecl quite a bit by this point and the operator indicated that the mine <br />has had around two weeks of nice weather that has not been overly hot. This should <br />help with the runoff this spring. <br />Signs and Markers: -All of the necessary signs were in place as required at the time <br />of the inspection. Mine ID signs were in place at the main entrance and at all of the <br />ponds along Colorado Highway 13 as required. Colowyo has a mine identification <br />sign at the acce~~s point (by the Sturgeon house) along Colorado Highway 13, which <br />is the access poiint to the Section 28 Pond. <br />Roads: -The minE~ access road and haul road to the Gossard Loadout is a paved <br />road. The road was wet and icy in spots at the time of the inspection but it was well <br />maintained and in good condition. <br />-The haul roads in the East and West pit areas were dry and appeared to be well <br />maintained and stable at the time of the inspection. No erosional problems were <br />noted on these reads. <br />-The light-use roads around the Gossard Loadout and to the rail loop were dry and <br />appeared to be well maintained and in good condition at the time of the inspection. <br />-The haul roads in the Bower project area (topsoil removal) are well maintained and <br />appear to be stable. These roads are in the Taylor Draw and along the west edge of <br />the Section 16 Pii. There is also a new haul road that was constructed just south of <br />the existing Secti~~n 16 Pit. This road is for continued topsoil removal operations in <br />advance of the raining in the South Taylor area. <br />-The light-use roads in the East Pit reclamation area were all still more or less <br />inaccessible due to snow. <br />-The Sturgeon road (to access the Section 28 Pond and the future Section 21 <br />Pond)was wet ar~d muddy at the time of the inspection. The road appeared to be <br />stable and no er~~sional problems were noted on the road. This road was somewhat <br />improved last fall) for the construction of the Section 28 Pond. The road was hard <br />bladed and Miss~~uri crossings were put in place. That work, along with the gravel <br />surfacing of the road, will need to be completed this spring/summer to get the road <br />up to light-use ro~~d standards. At that point Colowyo will need to submit an as-built <br />drawing and certification for the road. <br />
