3 � <br /> III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Support Facilities <br /> • Snow has fully melted and soils appear to have thawed and may have dried sufficiently to allow the <br /> approved 0.1 acre expansion of the sediment cleanout/coal waste temporary stockpile near the <br /> sediment pond to proceed. Gary Isaac indicated that arrangements were being made to have a <br /> contractor performthe expansion work, including tree cutting, ditch construction, soil salvaging, etc. in <br /> the near future. BLM and DRMS will need to be notified at least 48 hours prior to initiation of the <br /> project. <br /> • Dirt from the construction material stockpile had been used to build up the berm around the existing <br /> temporary sediment cleanings/coal waste pile, but in various segments of the berm the toe of the pile <br /> was almost to the level of the top of the berm. Additional berm buildup is warranted to prevent any <br /> spillage of coaly debris outside of the bermed area. <br /> 4 <br />
