3
III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
Support Facilities
• Snow has fully melted and soils appear to have thawed and may have dried sufficiently to allow the
approved 0.1 acre expansion of the sediment cleanout/coal waste temporary stockpile near the
sediment pond to proceed. Gary Isaac indicated that arrangements were being made to have a
contractor performthe expansion work, including tree cutting, ditch construction, soil salvaging, etc. in
the near future. BLM and DRMS will need to be notified at least 48 hours prior to initiation of the
project.
• Dirt from the construction material stockpile had been used to build up the berm around the existing
temporary sediment cleanings/coal waste pile, but in various segments of the berm the toe of the pile
was almost to the level of the top of the berm. Additional berm buildup is warranted to prevent any
spillage of coaly debris outside of the bermed area.
4
