.III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was a complete inspection of the McClane Canyon Mine surface facilities and office records. The mine site <br /> inspection was made on the morning of March 17, records were checked on the morning of March 21. 1 was not <br /> accompanied by an operator representative on the field inspection, but I did discuss concerns I had noted with <br /> Chuck Silengo during the inspection and with Gary Isaac during a phone conversation on March 25. Mine staff <br /> was not on site on March 21, due to Good Friday holiday; however a security guard was in the office during my <br /> records review. <br /> Weather was cloudy and cool; snow had recently melted in most areas and active work areas were quite muddy <br /> in most locations. Seasonal drainage maintenance work to clean out ditches, culvert inlets, and sediment sumps <br /> was in progress, and continued work will be necessary. Coal was being conveyed out of the mine during the <br /> inspection. <br /> Availability of Records <br /> Required records were on file and up-to-date through the 4 h quarter of 2007, with a couple exceptions noted in <br /> the attached Records form. The recent bond increase rider(to$319,280.00)and DRMS inspections <br /> subsequent to 11/07, need to be placed on file in the Records books at the mine office. <br /> Roads <br /> Road drainage structures were functional, but maintanence to clean out mud and remnant ice that accumulated <br /> during winter road maintenance activities is necessary in many locations. Maintenance was under way during <br /> the inspection and will need to be continued until the various road drainage ditch segments, culverts, <br /> berms, and sumps have been restored to original design condition. The 12" culvert beneath the road <br /> across from the pond inlet was partially blocked with icy debris, and needs to be cleaned out. The outlet <br /> end of the same culvert needs to be cut off to remove the ragged shards at the end of the culvert. <br /> Hydrologic Balance <br /> The diversion ditch south of the construction material stockpile was largely obstructed by compacted weedy <br /> debris and sediment in one location, but was cleared out during the inspection. <br /> The sediment pond contained muddy water, pool elevation just above the level of the gated primary spillway. A <br /> delta of coaly sediment extends for a considerable distance into the pond; cleanout would appear to be <br /> necessary this summer. <br /> The sediment sump in the ditch just upstream from the pond had filled in completely, but was being excavated <br /> during the inspection. Sump cleanings were being hauled up to the mine yard area and deposited in a location <br /> excavated within the waste coal temporary stockpile. <br /> The collection ditch in the coal yard area that runs from the toe of the steel half culvert drop structure <br /> down to the upper end of the inside road ditch along the MSHA berm was largely filled in with ice and <br /> mud, and needs to be cleaned out. <br /> 3 <br />
