(LRM), for the use of leased <br />C-BT Project water in a 2008 SWSP as allowed by the Interim Rule on the Use of Colorado-Blg <br />Thompson Project Water in Substitute Water Supply Plans and Plans for Augmentation adopted <br />May 13, 2005, by the Northern Colorado Water Conservancy District (Northern Water) Board of <br />Directors. The following summarizes the key issues for this approval and further requirements on the <br />use of leased C-BT Project water in the 2008 SWSP. <br />Northern Water staff has reviewed your request letter dated February 13, 2008, and follow-up emails. <br />The LRM 2008 SWSP is for the augmentation of gravel pit depletions from the Larimer Pit (MLR <br />No. M-74-069) and the Mariana Butte Pit (MLR No. M-88-033). These gravel pits are within Northern <br />Water boundaries; therefore, LRM meets the requirement that C-BT water be used only to offset <br />depletions that are the result of a beneficial use of water within Northern Water boundaries. <br />The intent of the Interim Rule is to allow the annual temporary lease of C-BT in annual SWSPs, <br />including plans for gravel pits. It should be noted, however, that the use of C-BT in a SWSP for a <br />given structure at a specific location shall not exceed a total of five years. <br />For its 2008 SWSP, LRM leased 9.0 acre feet for March 1, 2008, through October 31, 2008, of C-BT <br />Project water from the City of Loveland, which is a Class B municipal C-BT Account Entity. Per the <br />Interim Rule, the net yield of C-BT Project water leased from a municipal Account Entity for use in a <br />SWSP is 50 percent of the net C-BT Project water delivered to the appropriate river reach for depletion <br />replacement. This SO percent factor was appropriately applied in LRM's 2008 SWSP. <br />LRM must provide Northern Water with an updated monthly Accounting Table showing C-BT Project <br />water releases made for the 2008 LRM's SWSP, which ends February 28, 2009. This updated <br />accounting should list the actual river conveyance shrinkage assigned by the Division Engineer, along <br />with a running total of actual and projected C-BT Project water released for utilization by LRM during <br />the 2008 SWSP. Please make certain your calculations exhibit the fact that the amount of C-BT Project <br />
