March 24, 2008 <br />Pg. 2 <br />Rule 6.4.1 Exhibit A - Leal Description <br />In accordance with Rule 6.4.1(2), please locate the main entrance on a USGS topographic map showing <br />coordinates in latitude and longitude or Universal Transverse Mercator (UTM). Applicant has provided the <br />coordinates in writing, but the Rules require that the entrance be shown on a map. <br />Rule 6.4.3 Exhibit C -Pre-mining and Mining Plan MaQ(s) of Affected Lands <br />1) In accordance with Rule 6.4.3(b) and Rule 6.4.3(g), regarding the building that is located to the <br />northeast of and outside the permit area but inside the 200-foot perimeter, please confirm that the <br />owners, as shown on Exhibit CPre-Mining Map, are Clyde & Caroline Roy, and provide information <br />regarding the type of building. <br />2) In accordance with Rule 6.4.3(e), the type of present vegetation covering the affected lands should be <br />included in Exhibit C, not Exhibit J as submitted by applicant. <br />3) Page 4 in Exhibit D of the application states "approximately 2% of this is covered by structures...." <br />However, Map Exhibit CPre-Mining Map appears to indicate that substantially more than 2% of the <br />site is covered by structures. Please explain. <br />Rule 6.4.4 Exhibit D -Mining Plan <br />1) In accordance with Rule 6.4.4(f)(i), please provide the nature and thickness of overburden to be <br />removed. <br />2) In accordance with Rule 6.4.4(f)(ii), please provide the nature of the stratum immediately beneath the <br />material to be mined. <br />Rule 6.4.5 Exhibit E -Reclamation Plan <br />The plan calls for topsoiling and revegetating only 4.08 acres or approximately 30% of the disturbed area <br />due to the post-mining land use of commercial development. In accordance with Rule 6.4.5(b), Applicant <br />must be able to demonstrate that the proposed post-mining land use of industriaUcommercial is reasonably <br />assured. If Applicant is not able to do so, how does Applicant propose to stabilize the remaining 70% of the <br />disturbed area from water and wind erosion? <br />Rule 6.4.7 Exhibit G -Water Information <br />1) Exhibit G includes a table listing water wells within 600 feet of the site. However, in accordance with <br />Rule 6.4.7(2)(a), applicant must locate on Exhibit C (map) all wells on adjacent lands where such <br />structures may be affected by the proposed mining operations. <br />2) In accordance with Rule 6.4.7(2)(b), please identify all known aquifers. <br />Rule 6.4.19 Exhibit L -Permanent Man-Made Structures <br />There appear to be numerous structures on and around the proposed permit area. In accordance with Rule <br />6.3.12, when mining operations will adversely affect the stability of any significant, valuable and permanent <br />man-made structure located within 200 feet of the affected area, the applicant may either: <br />
