• • <br />committed in violation of an obligation of the Lessor under a provision of this Option <br />Agreement or, after the Lease attached hereto shall have been executed and activated, <br />of an obligation of Lessee under the Lease; provided, however, that nothing contained <br />in this paragraph shall impose any duties or liabilities on the Lessor in addition to those <br />which otherwise would exist at law or under this Option Agreement or under the Lease. <br />10. EXECUTION OF LEASE: In the event the option granted herein be <br />exercised, the Lessor shall, within thirty (30) days of the giving by Lessee of the notice <br />required in paragraph 2.1, above, execute in recordable form and deliver to Lessee two <br />copies of the Lease currently dated. Within five (5) days from the receipt of such <br />executed copies, Lessee shall execute in recordable form and deliver to Lessor one of <br />the two copies of the Lease executed by the Lessor under the requirements of the next <br />.preceding sentence. <br />11. NON-ASSIGNABILITY: This Option Agreement and the option granted <br />herein may not be assigned by Lessee without the written consent. of the Lessor first <br />~ given in writing, but such consent shall not be unreasonably withheld. Any such <br />consented to or unconsented to assigning shall not relieve Lessee in any way of its <br />obligations hereunder. The provisions of this paragraph. however. shat! in no way <br />qualify or impair the right of assignmen±, subletting or contracting granted to Lessee as <br />Lessee in paragraph 13 of the Lease. <br />'12. ARBITRATION: In the event of a dispute between the parties to this Option <br />Agreement, such dispute shall be submitted to arbitration in accordance with the terms <br />and provisions of paragraph 16 of the Lease. <br />5 <br />;~ ~~ <br />~U, <br />
