Stipulation No. S3 <br />ALL UNRESOLVED PERFORMANCE STANDARD ISSUES AND SUBMITTAL REQUIREMENTS SUCH <br />AS, BUT NOT LIMITED TO, GEOTECHNICAL STABILITY ISSUES, SEDIMENT CONTROL PLANS, <br />BONDING REQUIREMENTS, AND REVISED PAGE, MAP AND/OR EXHIBIT HARD COPY <br />SUBMITTALS, SHALL BE SUBMITTED AND APPROVED BY THE APPROPRIATE REVISION <br />PROCESS PRIOR TO PROJECT INITIATION. <br />STATUS: COMPLIED WITH 8/22/1994. <br />Stipulation No. S4 <br />FOR THE REFUSE PILE EXPANSION, MCC OR ITS CONSULTANTS SHOULD EITHER (1) PREPARE <br />A MORE DESCRIPTIVE JUSTIFICATION FOR THE SELECTION OF THE MECHANICAL PROPERTIES <br />USED IN COMPLETING THE ANALYSIS OR (2) PERFORM A SENSITIVITY ANALYSIS OF THE PILE <br />USING THE SELECTION OF COAL REFUSE STRENGTH VALUES CONTAINED IN THE EARLIER <br />LOWER REFUSE PILE STABILITY ANALYSIS. THIS INFORMATION SHOULD BE SUBMITTED ON <br />OR BEFORE FEBRUARY 17,1995. THE DISPOSAL OF THE COAL WASTE SHOULD NOT BEGIN <br />UNTIL THE INFORMATION REQUIRED HAS BEEN REVIEWED BY THE DIVISION. <br />STATUS: COMPLIED WITH 2/16/1995. <br />Stipulation No. SS <br />MCC MUST SUBMIT ADDITIONAL INFORMATION REGARDING A REPAIR PLAN FOR THE HAUL <br />ROAD. A PLAN VIEW OF THE SURFACE WATER DRAINAGE, CROSS SECTION OF BUTTRESS <br />WITH REFUSE PILE AT FINAL CONFIGURATION, AND ANYTHING ELSE REQUIRED AS A RESULT <br />OF THE REVIEW OF THE DESIGN AND STABILITY ANALYSIS OF THE BUTTRESS. <br />STATUS: COMPLIED WITH 8/1/1995. <br />Stipulation No. S6 <br />MCC MUST SUBMIT AN INFORMAL AGREEMENT WITH THE US FOREST SERVICE TO MONITOR <br />PONDS. MCC SHOULD PROVIDE A SIGNED COPY OF THE AGREEMENT WITH THE PAONIA <br />RANGER DISTRICT TO INFORMALLY MONITOR THE USFS SURFACE WATER RESOURCES <br />LOCATED ABOVE PANELS TO BE RETREAT MINED OR WITHIN THE ANGLE OF DRAW. THE <br />SIGNED AGREEMENT SHALL BE PROVIDED BY MAY 31,1995, TO BE INCORPORATED INTO THE <br />PERMIT. <br />STATUS: COMPLIED WITH S/4/1995. <br />Stipulation No. S7 <br />WITH SUBMITTAL OF PERMIT REVISION NO.6, MOUNTAIN COAL COMPANY HAS REMOVED <br />ALL PERMIT DOCUMENT REFERENCES TO MINING BENEATH THE DRY FORK OF MINNESOTA <br />CREEK INTERMOUNTAIN DIVERSION AND RESERVOIR SYSTEM, INCLUDING REFERENCES TO <br />68 <br />
