At <br />that time you examined the excavated abatement site and. agreed that the fuel. release area had. <br />been excavated to an acceptable extent and could be backfilled with clean, inert material. <br />Backfilling of the excavated abatement site was completed shortly after your inspection. <br />As noted in your ]February 22, 200$ report of the above-referenced inspection, material <br />excavated from th.e fuel release azea was stockpiled southeast of the excavation and below the <br />ultimate water line of the reclaimed pit, and at the time of the inspection contained a noticeable <br />amount of diesel fuel. This material was hauled to an upland location west of the pit area <br />(between the two future ponds). The material was spread out to an approximate depth of 1 %2 to <br />2 inches over an approximate 75-foot by 100-foot area. As you requested, a photo of the azea <br />where the contaminated material was stockpiled and a photo of the azea where this material was <br />spread. out aze enclosed. The material. will be incorporated into upland reclamation that will not <br />be subject to inundation when de-watering ceases. <br />During the November 16 inspection you also noted other oil staining not related to the diesel fuel <br />spill. This staining was in soils below the concrete foundation of silos that had been associated <br />with an asphalt plant that was operated on site during mining. A sample of the impacted soil was <br />collected by Scott: Rutherford of Paragon Consulting during the inspection on November 16, <br />2007. After completion of the soil abatement activities on November 20, Mr. Rutherford <br />collected four (4} confirmation samples at the locations noted on the enclosed sketch.
