Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Red Dirt Pit 110 Application, File No. M-2008-008. The <br />Division of Reclamation, Mining and Safety (Division) is required to make an approval or denial decision no <br />later than April 2, 2008, therefore, your response to the following adequacy review concerns should be <br />submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.3 (3), please submit the proof of publication of the public notice circulated in the <br />local newspaper. Proof of notice maybe return receipts of a Certified Mailing or by proof of personal <br />service. <br />2. Rule 6.3.2 Exhibit B -Site Description Please address the following items in the Site Description; <br />a. The applicant states there is no published soils data for the site. Please contact the Middle Park <br />office of the Soil Conservation Service for soils data for the site. <br />b. The applicant states the plant community is 95 percent trees and 10% grass, forbs and brush. <br />Please revise the percentages of the plant community to equal 100%. <br />3. Rule 6.3.3 Exhibit C -Mining Plan Please address the following items in the Mining Plan; <br />a. Please specify the maximum dimensions of the topsoil stockpiles. <br />b. Please specify the dimensions of the existing roads that will be used for mining operations. The <br />Mining Plan states access is an existing driveway; however two (2) access roads are indicated on <br />Exhibit E-1. Please clarify the discrepancy. <br />c. The applicant states little or no water will be used at the site. If dust control water is used it will <br />be obtained from sources Grand County has available and approved for that use. The contract <br />with the USFS states Grand County shall provide dust control along FDR 100 during period of <br />mining.
