Summary <br />The Review Process <br />Environmental Alternatives Inc submitted an application for a permit to conduct surface <br />coal mining and reclamation operations on behalf of Northfield Partners, LLC, the <br />proposed permittee. The application was received by the Division of Reclamation, <br />Mining, and Safety (Division) on June 1, 2006. The underground mine will be <br />developed on private land, located approximately 2 miles west of Florence, Colorado in <br />Fremont County. Also submitted with the application was a check in the amount of <br />$500.00 for partial payment of the $2500.00 permit application fee as allowed by Rule <br />2.01.6(3). The application was reviewed by the Division and found incomplete. In a <br />letter dated June 12, 2006, the Division notified the applicant of the incomplete <br />determination and identified the issues that required resolution in order to make the <br />application complete. The applicant responded by submitting additional materials to <br />address the deficiencies, received by the Division on September 12, 2006. Following <br />review of this information, notification of the filing of a complete application was <br />forwarded to the applicant on September 22, 2006. This notification was also sent to <br />the appropriate governmental agencies as required by Rule 2.07.3(3)(b), including the <br />Division of Wildlife, Fremont County Planning Department, Fremont County <br />Commissioners, State Historic Preservation Office (SHPO), Water Quality Control <br />Division, Air Pollution Control Division, Natural Resources Conservation Service Canon <br />City District, Colorado Geological Survey, Colorado Natural Heritage Program, <br />Colorado Division of Water Resources, US Army Corp of Engineers, SE Colorado <br />Water Conservancy District, US Fish and Wildlife Service, and the Office of Surface <br />Mining (OSM). <br />The Division queried the Applicant Violator System (AVS) on November 7 and 8, 2006. <br />The AVS recommendation and OSM evaluation resulted in "no violations". The Division <br />recommendation for the preliminary AVS check was "Issue". <br />The SHPO responded to the notification of the filing of a complete application in <br />correspondence letters as follows; <br />• letter dated January 30, 2006 from SHPO to Environmental Alternatives <br />• letter dated September 29, 2006 from SHPO to the Division <br />• letter dated November 9, 2006 from SHPO to the Division <br />In a letter dated November 20, 2006, the Division requested clarification regarding the <br />necessity and scope of a cultural resource survey to be conducted over the proposed <br />disturbed area and other areas within the proposed permit boundary. The SHPO <br />responded in a letter received by the Division on January 16, 2007 that a cultural <br />resource survey was required over the proposed disturbed area and area to be subsided. <br />The Division forwarded the SHPO response to Northfield Partners under a cover letter <br />dated January 16, 2007. A cultural resources survey was conducted by Metcalf <br />Archaeological Consultants (MAC) in early April 2007 for the surface facility area west of <br />3 <br />
