We have sent several objections to allowing the permit azea even be renewed because of <br />violations they have done and they had not ever come and talked with us. Some things needed to <br />be worked out and we sent certified mail requesting it not be renewed because of distortion of <br />facts. <br />Ross said that Mr. Irvine printed the value of the PH for prime topsoil not to exceed 7.4. This <br />was an internal paper that had not even been completed yet . Mr. Irvine was suppose to be a very <br />top soil scientist. Avery educated man. Out of all the reseazch and the numerous pages of data <br />claimed in all these yeazs which state 8.4, I"m sorry I do not buy this. Ross has permitted the <br />land over and over agin making 1000's of copies and in these copies over and over again, the PH <br />for prime farmland has always been 8.4. Ross is also very well educated and this stuff is almost <br />automatic for him. Out of all of these pages, why is just this one unfinished internal paper being <br />used now? I worked for Western Fuels for 13 years and for those soil types, slopes, alfalfa, the <br />PH has always been up to 8.4. <br />Mr. Deazstyne seems to know his stuff and classified Morgans' property All of Morgans <br />property south west of the intersection of BB and 27 Roads as Prime Farmland. This we know to <br />be true and was a very good outcome of the meeting. This land has been farmed by the Morgans <br />for the last 50 yeazs and by me personally for 17 yeazs. <br />Ross had a Backwazds Plan and a Forwazd Plan. We have filed a default with Western Fuels <br />because of the 3 days and 3 nights of removing our prime topsoil and putting it on Bensons. We <br />don't know for sure how they can correct this especially at the time they started doing it,. Mr. <br />Frank Morgan and Mike Morgan asked Lance why are you taking our best topsoil off our <br />property and putting it on Bensons. Lance said this is not a democracy, this is communism, those <br />who have give and those who do not, Take. This wasn't a PH error. They knew for fact that this <br />was some of our very best topsoil and they had really messed up on Bensons by putting the road <br />base gravel off of 27 road in with the topsoil and nothing would grow, so they took our best <br />topsoil to satisfy MR. Benson. We begged them not to and after 3 days and 3 nights asked them <br />if they were not going to stop ,that we would contact someone. They have always made you out <br />to be the bad guy, so we didn't know where to turn, now we do. Bensons property did not have <br />anywhere neaz the type of soil we have. This was put on his place just North and East of 2700 <br />Road. We do not know what the forwazd plan should be for this, but that topsoil can never be <br />replaced nor can the prime topsoil put down Ramp 1. <br />Ross said a 40 inch depth would be put back. That should be a minimum of 48 inches. If there is <br />more, then more should be returned tour property. They have always done 2 lifts. When they got <br />over here, they did One lift and threw everything together. We are thankful that they have to go <br />back to two lifts, but they should have to get all of our soil to bedrock regardless of the depth. <br />I have enclosed a photo form 1998 of the "Sunshine Corner" just SW of the intersection of BB <br />and 2700 Road. The term "Improved Pasture" sounds so much better than Dryland and for the <br />azeas that aze actually dry land, this is a good term. But, they want to put this "Sunshine Corner <br />back into this Improved Pasture which is unacceptable. This was one of our leading producers <br />for alfalfa and corn. Just prior to them taking possession, this field had been re-done with prime <br />alfalfa and we had sold Weimers 200 ton of Alfalfa off that one little field besides Patty Morgan <br />100 ton. Weimers have written the Division a letter to that effect. The mine leases the coal and <br />they pay a dollaz amount for the value of that coal. We have the surface rights leased and what <br />we have produced in the past , we aze losing out $557,000 for the yeazs the mine has already had <br />it.
