The violation was issued for failure to <br /> construct the refuse area pond by the approved date. <br /> Late 1978 - Early 1979: Snowmass Coal Company (then Anchutz Coal Co. ) <br /> constructed the sedimentation pond below the refuse pile. <br /> May 7, 1979 - MLRD Inspection: Carol Pahlke and Roger Funston were <br /> inspectors, Craig Sherwood was the Snowmass contact. <br /> Inspection Report Record: "Cracks were forming in the dam <br /> which forms a sediment pond at the toe of the refuse dump." <br /> "Stability of this structure is questionable. " No Division <br /> action taken. <br /> May 13, 1980 - MLRD Inspection: Roger Funston, inspector; Craig <br /> Sherwood, contact. <br /> Inspection Report Record: "There are signs of instability of <br /> the embankment of the sediment pond below the pile . . . tension <br /> cracks with a potential for sloughing." <br /> Compliance Action: "Reconstruct this embankment to ensure <br /> stability within 90 days (by August 13, 1980)".
