Cattany <br />Division Director <br />Natural Resource Trustee <br />On February 8, 2008 the Division of Reclamation, Mining and Safety (DRMS) issued its <br />recommendation for approval of the Whirlwind Mine application over objections. This <br />document is intended to explain the process by which DRMS arrived at its approval <br />recommendation over objections. <br />A 112 Designated Mining Operation (DMO) application for the Whirlwind Mine was filed with <br />DRMS on July 26, 2007 by Energy Fuels Corporation. Per Rule 1.4.1(7) DRMS classified the <br />application as complex with a 150 day review period. The original Decision Date was set for <br />December 24, 2007. A request for an extension to the Decision Date by the applicant was <br />granted to February 8, 2008. The application proposes an underground uranium mining <br />operation, located on 31.91 acres of Bureau of Land Management (BLM) administered lands, <br />approximately 5 miles west of Gateway, Colorado in Section 36, Township 51 north, Range 20 <br />west of the 10th Principal Meridian. The current land use is wildlife habitat and rangeland. The <br />site will be restored to wildlife habitat and rangeland per the reclamation proposed for post <br />mine land use. All mine openings will be sealed, all structures removed and waste piles will be <br />graded to 3:1 slopes and re-vegetated with a BLM rangeland seed mix. <br />Comments Received <br />The public comment period for the application closed on October 11, 2007. During the public <br />comment period, DRMS received written comments from the following: <br />Colorado Historical Society dated August 6, 2007, received by DRMS on August 9, 2007. <br />CHS did not object to the application in its letter to DRMS. <br />2. Comments from Information Network for Responsible Mining (INFORM), Dated October 10, <br />2007, received by DRMS on October 11, 2007.
