superstructures, pump house, silo fan and silo conveyor structures had been demolished and removed <br />from the loadout site as well. The concrete pad in front of the demolished silos remains. <br />To the north of the silo area, the shop and fuel facility, with its two 500 gallon fuel tanks, remain. To the <br />south of the silo area, the substation and fence also remain. On the far side of the adjacent orchard, the <br />loadout facilities pump house remains. <br />The covered elevated conveyor and struts leading from the silos to the train loading structure were gone. <br />The motor control center building superstructure associated with the elevated conveyor was also gone. <br />The train loading structure had been demolished and removed offsite. The 3,500 and 15,000 gallon deicer <br />tanks located adjacent to the train loading structure were gone. <br />The only concrete removed from site was most of the concrete gravel from the silo demolition. Some <br />concrete gravel, all concrete slabs and footers, the truck unloading tunnel and the silo concrete pad <br />remain. Concrete walls were demolished but remain on site. <br />The sediment control system at the unit train loadout was functioning properly. Review of Division <br />inspection reports showed that there have not been any compliance problems at the loadout. <br />There are two tables in the attachment. The first table is on four pages and is titled "Partial Phase 1 Bond <br />Release". The second table is on one page and is titled "Total Loadout Reclamation". The first table <br />details the individual reclamation costs that are releasable for the structural demolition tasks performed at <br />the unit train loadout. Each individual structure is listed under the column heading of Demolition Task. <br />The method of calculating the cost liability for each individual structure is the Division's computerized <br />program named CIRCES and is shown under the column heading of Reference. Under the column <br />heading of Quantity, the amount or volume of material used in calculating the bond liability for each <br />structure is shown. The units are shown in the adjacent column where CF stands for cubic feet, SF stands <br />for square feet and LF stands for linear feet. If a zero appears under the Quantity heading, then that <br />structure was not demolished and no bond can be released for it. The unit cost to demolish an individual <br />structure is shown under the Unit Cost column heading. The total releasable bond associated with an <br />individual structure is shown under the Total Cost column heading. Again, if a zero appears for a <br />structure, then that structure remains in place at the loadout and bond money can not be released for it. <br />The first table shows that the total demolition costs for the work done amount to $1,554,653.09. <br />The second table shows the total demolition costs, also called total indirect costs, added together with the <br />other costs, which include insurance and bonding, job superintendent and engineering fees, administrative <br />costs and profit. As shown on this second table, the total SL-3 applicable loadout reclamation cost is <br />$1,893,923.47. The partial Phase One Bond Release amount is 60% of this value, or $1,136,353.80. <br />SUMMARY AND FINDINGS OF COMPLIANCE <br />The Division has completed its review and evaluation of the partial Phase One Bond Release request <br />submitted by BRL for the Bowie No. 1 Mine. The Division finds that structural demolition and disposal at <br />the unit train loadout, as detailed in the Division's Proposed Decision and Findings of Compliance for the <br />partial Phase One Bond Release (surety release SL-3), have been successfully performed in compliance <br />with the reclamation plan that was approved in the Bowie No. 1 Mine permit application and with the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining and the Colorado Surface <br />Coal Mining Reclamation Act. The Division's findings are based on the evaluation of the information <br />supplied in BRL's SL-3 bond release submittal, as well as on information gathered in the bond release <br />field inspection, previous field inspections and review of the permit application package. <br />5 <br />
