III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division of Reclamation, <br /> Mining and Safety. James Counts represented the operator. With the operator's consent,this report was <br /> issued from the Denver office of DRMS. <br /> The King I Mine was mining coal in the Tipotsch lease. The King II was mining several hundred feet <br /> in from the portals. The ground was covered with more than 3 feet of snow which limited inspection. <br /> Availability of Records <br /> All required records were available (see attached list). <br /> Signs and Markers <br /> King I -Mine i.d. signs and affected area markers were properly displayed. <br /> King II—A mine i.d. sign was on display at the mine's entrance on County Road 120. The perimeter <br /> of the affected area was marked with"permit boundary" signs and survey stakes. <br /> Roads <br /> King I - The mine entrance haul road was well maintained. <br /> King II - The haul/access road was well maintained. <br /> Hydrologic Balance <br /> King I Ponds - The east and west ponds appeared to contain little water underneath the snow cover. <br /> Embankments, inslopes, and spillways could not be inspected due to snow cover. Both ponds had <br /> sediment level markers in place and appeared to have adequate sediment capacity. <br /> King II Pond—The pond did not appear to contain water. Snow cover limited inspection. <br /> King I Ditches - Not inspected due to snow cover. <br /> King II Ditches—Not inspected due to snow cover. <br /> Monitoring Wells - Not inspected due to snow cover. <br />
