<br />The Review Process
<br />The original pennit for the Blue Ribbon Mine was obtained by Sunflower Energy Corporation in 1977. The
<br />application was submitted in November 1976, amended in August 1977, and subsequently approved later in
<br />1977.
<br />Sunflower Energy Corporation submitted a permit application to comply with the provisions of the Colorado
<br />Permanent Program requirements on February 17, 1981. This application was found to be complete on
<br />February 27, 1981, and the Division's Preliminary Adequacy Review comments were sent to the operator on
<br />April 23, 1981.On May 20, 1981, the Blue Ribbon Coal Company succeeded Sunflower Energy Corporation
<br />as operator of the Ellue Ribbon Mine.
<br />Blue Ribbon Coal Company was a Colorado Partnership. The partners included Hawk Mining, Inc., North
<br />Fork Energy Corporation, and Cedaz-Crest. Western Associated Coal Corporation managed the partnership's
<br />business.
<br />Blue Ribbon Coal Company submitted the Preliminary Adequacy Review response on October 8, 1981.
<br />Additional review comments were forwarded from the Division to the operator on November 30 and December
<br />4, 1981, and the Division received responses from Blue Ribbon Coal Company on January 5, 1982, May 17,
<br />1982, and July 27, 1982. These responses satisfied issues raised during the review processes. The final
<br />decision to approve the permit application was made December 8, 1982.
<br />An application to renew the permit was submitted on June 15, 1987. It was found to be complete on June 15,
<br />1987, and the Division's preliminary adequacy review was sent on August 6, 1977. Blue Ribbon Coal
<br />Company submitted responses to the adequacy review on August 31, 1987. The Division made a decision to
<br />approve the permit renewal on November 20, 1987 and the permit was issued on January 15, 1988.
<br />On January 3, 1990, MINREC, Incorporated, succeeded Blue Ribbon Coal Company as operator of the Blue
<br />Ribbon Mine.
<br />A second permit renewal was applied for by MINREC, Inc. on July 6, 1992 and was found to be complete on
<br />July 13, 1992. The Division's preliminary adequacy review was sent on September 2, 1992, and MTNREC's
<br />responses were received on October 19, 1992, in the form ofa technical revision. The technical revision, which
<br />addressed the issues raised in the preliminary adequacy review, was approved on December 18, 1992, and the
<br />permit was subsequently issued.
<br />A third permit renewal was applied for by MINREC, Inc. on June 5, 1997 and was found to be complete on
<br />June 5, 1997. The Division made a decision to approve the permit renewal on December 9, 1997.
<br />A fourth permit renewal application was received from MINREC, Inc., on May 20, 2002, and called
<br />complete on May 30, 2002. The decision to approve the permit renewal was made on December 9, 2002.
<br />The required 270 day notice for Permit Renewal No. 5 was sent on April 4, 2007. The permit renewal
<br />application was submitted by Minrec, [nc. and was received at the Division on April 30, 2007. [n a letter dated
<br />May 7, 2007, the Diwision informed Minrec that the submittal was incomplete, due to an insurance policy that
