Although the surface land for the quarry and the associated quarry yard is <br />entirely privately owned, most of the mine area (up to 90%) consists of federally-owned <br />mineral estate administered by the Bureau of Land Management (BLM) White River <br />Field Office (WRFO). <br />The most recent sales contract brokered by the BLM at the Flagg Creek Quarry was <br />issued to the White River Stone Company on November 26, 2007, with an expiration date <br />of January 26, 2008. Prior to the initiation of this contract, it was discovered that the <br />Flagg Creek Quarry was not in compliance with the approved environmental analyses <br />required for proposed actions involving federal realty (as per the National Environmental <br />Policy Act of 1969). As such, ashort-term (60 day), small volume (800 tons) contract <br />was issued to the operator for the sale of only previously excavated material stockpiled in <br />the quarry yard. This contract allowed the operator sufficient time to fill any outstanding <br />customer orders prior to their winter season shutdown while simultaneously avoiding any <br />further unauthorized, unapproved surface disturbance at the mine site. All operations <br />related to the excavation and removal of flagstone from the mine location was terminated <br />by the BLM on November 28, 2007. <br />~~ ~~~ <br />FfB 0 6 2008 ~ <br />The operator (White River Stone Company), permittee (PC Management), and owners <br />(Quality Quarry, Flagg Creek Quarry, James Ritchie) have all been informed on <br />
