Box 483 <br /> Paonia, CO 81428 <br /> Bowie No. 2 Mine, C-1996-083 <br /> Complete, oversight inspection <br /> December 5, 2007 <br /> Participants: <br /> Bill Bear, Bowie Resources, LTD (BRL) <br /> Joe Dudash, Colorado Division of Reclamation, Mining, and Safety (DRMS) <br /> Christine Belka, &Henry Austin, Office of Surface Mining (OSM) <br /> We participated in a complete, oversight inspection of the Bowie No. 2 Mine with the above on <br /> December 5, 2007. The joint, DRMS / OSM Oversight Team selected this mine for a complete <br /> inspection during evaluation year 2008. The primary focus of this inspection was an evaluation <br /> of off-site impacts. Weather conditions were cold and clear. Ground conditions were wet from <br /> melting snow throughout the mine site. The inspection did not reveal any off-site impacts on or <br /> adjacent to the disturbed areas inspected. <br /> Mr. Dudash conducted a thorough permitting and environmental monitoring records review at <br /> the Mine No. 2 office to begin our inspection including: DRMS permit term is from 4/4/07 to <br /> 4/4/12 and the most recent DRMS Permit findings document is on file. We discussed the <br /> outstanding permit stipulations. Stipulation 9 (seismic monitoring of Bruce Park-Terror Creek <br /> reservoir is an on going stipulation), stipulation 10 (USFS water rights stipulation is outstanding <br /> and a USFS letter addressing this stipulation is required), stipulation 14 (CO-Division of Wildlife <br /> stipulation regarding the woody stem plant density success standard is outstanding), stipulation <br /> 24 (TR-45 for the proposed gob conveyor over old State Hwy. 133 and the Fire Mountain Canal <br /> is outstanding. It appears BRL will not proceed with the gob conveyor revision.), and stipulation <br /> 25 (Stipulation 25 involves abatement requirements regarding a DRMS notice of violation issued <br /> for topsoil and rooting media removal, utilization, and storage from the new ventilation & shaft <br /> facility being developed on Hubbard Creek. This ventilation facility disturbance, and part of the <br /> roadway access is located on USFS land. This was discussed with Ryan Taylor, USFS-Paonia <br /> Office on December 11 2007. Mr. Taylor is monitoring the development of this facility.) <br /> Monthly <br /> NPDES / DMR's were reviewed and are current through the 3rd quarter for 8 total outfalls <br /> including sediment ponds and the mine water pumping bypass (B seam mining development for <br /> the past 3 years has not necessitated routine mine water pumping). The DMR discharge history <br /> does not document any non-compliant discharges within the past year. Pond certification <br /> statements are all on file as required. <br />
