• Benson presently owns 44 shares of Colorado Cooperative Company <br />irrigation water. <br />• Benson has traded coal royalties for land ownership on land (east of 27 Rd) <br />that is currently under Reclamation Bond Liability and is currently planted in <br />Irrigated Pasture. Benson's 44 shares are more than committed to <br />maintaining the 62 acres of IP east of 27 Rd. <br />• WFC will return this 38.97 acre tract to a Dryland Pasture. This post mine <br />revegetation plan will insure the land will remain stable for years to come. <br />• The site will be graded in a way that irrigation water could be brought to the <br />site in the future, if the owner obtains these rights. <br />Lloyd Parcel: The parcel of 38.86 acres immediately north of BB Road and <br />immediately west of the aforementioned Benson parcel owned by Lloyd. <br />• This tract was originally classified by Peabody Coal as Irrigated Pasture. <br />• This 39 acre tract was "Wild Fiood Irrigated' in the past. That is to say, there <br />wen: no furrows, gated pipe, side roll sprinkler system or other methods to <br />control water distribution. Irrigation water was allowed to traverse over the <br />land at will. <br />• Lloyd family owns 24 shares of Colorado Cooperative Company irrigation <br />water and all of it is dedicated to this tract. <br />• This tract of land has been abarxioned from active farming for at least 15 <br />years, according to pre disturbance satellite images and the size and <br />distribution of invasive roseisage brush and noxious weeds. <br />• The tract of land is owned by five different families and all but one lives out of <br />state. <br />• There is no evidence the land was ever developed into a tract suitable to be <br />irrigated by a sprinkler system, but rather a flood irrigation technique was <br />utilized. <br />• Using the ratio of one (1) share of water per acre of irrigated land under a <br />side roll sprinkler, only 19 acres can be irrigated per full quarter mile side roll <br />system. If a side roll system was used, there would be a surplus of 5 water <br />shares. <br />• The 24 shares are insufficient for fu[I irrigation of the parcel under side roll <br />irrigation. If flood irrigation is used, which is more likely than side roll for the <br />future farming of this tract, a ratio of 1.6 shares per acre is needed, which <br />means that only 15 acres could be irrigated. <br />• WFC is reclassifying this land to Dryland Pasture because the land has been <br />abandoned from active farming for over 15 years and the majority of the land <br />owners live out of the community. It is not reasonable to assume that this <br />parcel would be actively farmed in the future when it was not in the past. <br />• Dan Mathews and Mike Boulay from DBMS has visited the site and <br />mentioned that it looked abandoned to them as well. <br />WFC Parcels: The 2 parcels of 15.35 acres and 42.25 acres immediately west of the <br />Lloyd parcel, which are now owned by Western Fuels.
