We have contacted Mr. Young and made him aware of your concerns and questions. <br />Mr. Young is working on his response we will forward his report as soon as we receive it. <br />We did talk to Mr. Young on the telephone about the contour interval not being 20 feet <br />but rather 10 feet he used 20 feet not the 10 feet that would have been correct. <br />3. In order for the applicant to make an informed determination on the impacts to the <br />hydrologic balance we have engaged Kleinfelder Engineering to evaluate the situation. <br />The present plan is to drill some monitoring wells where Kleinfelder directs and for the <br />engineers to collect field data and then to analyze and then to answer the question of <br />structural stability. The Rocky Fard Canal Company will be informed of all the results as <br />well as the Division of Reclamation, Mining and Safety. This course of action was started <br />on January 14, 2008. <br />4. The applicant is pursuing the question about the ground water elevation with due <br />diligence and will know soon. However the applicant has committed to not mining into <br />any ground water and shall cover any spots that might have ground water with 2 feet of <br />overburden and not continue mining at said location. The applicant and the Rocky Ford <br />High Line Canal Company are working on this situation presently. Again the operator <br />shall not mine into ground water. <br />Rule 6.4.14 Exhibit N- Source of Legal to Enter <br />5. The applicant and the Rocky Ford High Land Canal Company are Presently Working <br />on all of the agreements that would allow the applicant Legal Right to enter and to build <br />the portable bridge across the canal. We hope to have all the agreements soon. <br />Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />6. The agreement. is not in place for the man-made structures at this time however both <br />parties are working them out. The agreement with the Rocky Ford High Line Canal is <br />still in negotiations and will be settled soon.
