with all requirements of the Contract Documents. Compliance is a duty of the <br />CONTRACTOR, and said duty shall not be avoided by any act or omission on the part of <br />ENGINEER or any inspector(s). <br />All materials and articles furnished by CONTRACTOR shall be subject to rigid inspection, <br />and no materials or articles shall be used in the Work until they have been inspected by <br />ENGINEER or his authorized representative. No portions of the Work shall be backfilled, <br />buried, cast in concrete, hidden, or otherwise covered until it has been inspected by <br />ENGINEER or his authorized representative. Any portions of the Work so covered in the <br />absence of inspection shall be subject to uncovering. Where uninspected Work cannot be <br />uncovered, such as in concrete cast over reinforcing steel, all such Work shall be subject to <br />demolition, removal, and reconstruction under proper inspection and no additional payment <br />will be allowed therefore. <br />D. Time of Inspection and Tests <br />Samples and test specimens required under these Specifications shall be furnished and <br />prepared for testing in ample time for the completion of the necessary tests and analysis <br />before said articles or materials are to be used. CONTRACTOR shall famish and prepare <br />all required test specimens at CONTRACTOR's expense, in accordance with the <br />Specifications. <br />Whenever CONTRACTOR is ready to backfill, bury, cast in concrete, hide, or otherwise <br />cover any Work under the Agreement, he shall notify ENGINEER not less than 48-hours in <br />advance to request inspection before beginning any such Work of covering. Failure of <br />CONTRACTOR to notify ENGINEER at least 24-hours in advance of any such inspections <br />shall be reasonable cause for ENGINEER to order a sufficient delay in CONTRACTOR'S <br />schedule to allow time for such inspections and any remedial or corrective Work required, <br />and all costs of such delays, including its effect upon other portions of the Work, shall be <br />borne by CONTRACTOR. <br />E. State Engineer Inspections <br />1. CONTRACTOR shall give ENGINEER 7-days advanced notice of completion of <br />excavation and foundation preparation, so that the State Engineer can receive 5-days <br />advanced notice. CONTRACTOR shall give ENGINEER 12-days advanced notice of <br />project completion so that State Engineer can be given 10-days notice. <br />^ F. Sampling and Testing <br />1. When not otherwise specified, all sampling and testing shall be in accordance with the <br />methods prescribed in the current standards of the ASTM, as applicable to the class and <br />nature of the article or materials considered; however, COMPANY reserves the right to use <br />any generally-accepted system of inspection which, in the opinion of ENGINEER will <br />ensure COMPANY that the quality of the workmanship is in full accord with the Plans and <br />Specifications. <br />' 2. Any waiver of any specific testing or other quality assurance measures, whether or not such <br />waiver is accompanied by a guarantee of substantial performance as a relief from the <br />specified testing or other quality assurance requirements originally specified, and whether <br />' 01110-9 <br />~~ <br />
