Specific compliance control and monitoring practices are <br />identified and discussed in Sections 2.05.3, Operation Plan - Pernuc Area, and 2.05.4, Reclamation <br />Plan. In addition, OMI has obtained and maintains ongoutg compliance with required air quality <br />permits administered by the Colorado Department of Public Health and Environment -Air Pollution <br />Control Division, water quality permits administered by the Colorado Depanment of Public Health <br />and Environment -Water Quality Control Division, mine health and safety approvals under the <br />Federal Mine Safety and Health Administration, and a number of other Federal, State, and local <br />permits and approvak. <br />A full listing of existing approved permits a provided in Section 2.03.10, Identification of Other <br />Licenses and Permits, and current copies of these other permits are provided in Exhibit 2.03-E4, <br />Other Permits. OMI haz maintained an effective record of permit compliance during their <br />management and operation of the Oxbow mining operations. To date, there have been no major <br />violations of any mine environmental or health and safety standards tinder OMI's operation and there <br />have been no minor violations within the past three years as documented in Section 2.03.5, <br />Compliance Information. <br />2.05.5 -Postmining Land Use <br />OMI proposes to return surface areas disturbed by mining and related activities to a postmining land <br />use of undeveloped lands utilized for very limited grazing and dispersed wildlife habitat and <br />recreational rues with the potential for small-scale industriaUmining operations installations adjacent <br />to the existing highway comdor. The proposed postmining land use is consistent with both the <br />premining condition and ]and use as described in Section 2.04.3, Site Description and Land Use <br />Information and Gunnison County land use designations (for those areaz within Gunnison Count}. <br />Delta County has not adopted fomtali7xd zoning or land use designatioris. Restoration of duttubed <br />• lands consistent with the proposed postmining ]and will be accomplished through application of the <br />reclamation methods, techniques, and activities identified and described in Section 2.05.4, <br />Reclamation Plan, and detailed and illustrated in both the Postmining Topography and Land Use <br />Maps, (Maps 2.05-M6 through 2.05-M8), and Exhibit 2.05-E5, Reclamation Details. Areas that are <br />either currently disturbed or will be disturbed in the future that will be reclaimed and returned to the <br />proposed postmining land use are owned or controlled by either OMI or the United States az <br />indicated by the Surface Ownership Map, (Map 2.03-M1). Consistent with and in support of the <br />proposed postmitting land use, the following developed features will be retained or established during <br />site reclamation: <br />• Portions of the Bear Creek Facilities area, Bear Creek degazsification site and Lower <br />Hubbard Creek Facilities area will be reclaimed and returned to undeveloped/public use <br />consistent with the objective of maintaining access to adjacent public lands. <br />• Affected segmenu of Bear Canyon, Lower Hubbard Creek, and Upper Hubbard Creek <br />roads and anyassociated culverts will be retained for landowner and public access. <br />• The Upper Hubbard Creek Facilities area will be reclaimed az a parking lot and trailhead <br />to provide access to adjacent U.S. Forest Service lands. <br />• The existing culinary water supply, treatment, and storage system will be retained to <br />continue to supply domestic water to the Town of Somerset. <br />• The West Valley haul road will be left in place and maybe partially reckumed or modified <br />• to reduce iu width in order to provide continued public access to the Somerset <br />Cemetery, the 200,000 gallon culinary water tank, and Elk Creek Canyon. <br />• The Elk Creek road will be retained to provide continued access up Elk Creek Canyon. <br />PR04 2.05-70 Revised August 2000 <br />
