the permit during the RN-04 permit term by Minor Revision No. 25 (MR-25). The stipulation <br />required submittal of an "incidental permit boundary revision" technical revision application, to <br />incorporate a segment of a light use road constructed to access an emergency drill pad location in the <br />McClane Canyon Mine permit area. The stipulation was satisfied by submittal of Technical <br />Revision No. 20 (TR-20), and was terminated on January 5, 2006. <br />Summary of Permitting Actions <br />The RN-04 renewal permit was approved February 14, 2005, and expires January 13, 2008. <br />Permitting actions approved between February 14, 2005 and August 19, 2005, are summarized in the <br />Mid-Term Review findings dated August 19, 2005. Permitting actions processed between August <br />20, 2005 and December 12, 2007, include five technical revisions (TR's), and eleven minor revisions <br />(MR's). These permitting actions are described below. <br />Technical Revisions <br />TR-19 proposed decision was issued October 24, 2005. The revision allowed for modification of the <br />coal waste disposal area sediment pond, including elimination of the existing open channel <br />emergency spillway and installation of a CMP pipe emergency spillway. The revision also allowed <br />sediment removal from an adj acent ephemeral channel segment that was partially filled in by a high <br />flow event, which had impacted a road culvert near the pond embankment. <br />TR-20 proposed decision was issued June 8, 2006. The revision allowed for modification of the <br />permit boundary to form a more logical block, to incorporate a segment of light use road associated <br />with an emergency drill pad site in the McClane Canyon Mine permit area, to narrow the permitted <br />corridor, along the private land segment of the mine entrance road, and to correct previous <br />inaccuracies regarding permit acreage listings. The various changes resulted in a decrease in private <br />land acreage, increase in federal land acreage, and anover-all permit area reduction of 21 acres (to <br />approximately 1,028 acres). The revision also allowed for several alluvial wells that were no longer <br />required for monitoring to be sealed and abandoned. <br />TR-21 proposed decision was issued August 2, 2006. The revision incorporated updated permit <br />tables and figures to clarify location and nomenclature associated with alluvial wells used for <br />baseline data collection and on-going monitoring. <br />TR-22 proposed decision was issued May 23, 2007. The revision application incorporated updated <br />reclamation plan details and scheduling, to accommodate implementation of final reclamation <br />activities during 2007, several years prior to original projections. Based on documentation and <br />explanation provided by the operator, the wording of permit Stipulation No. 32 was amended by TR- <br />22, to require submittal of private landowner request for retention of the lower (private land) segment <br />of the access/haul road "prior to submittal of Phase 1 Bond Release application". <br />TR-23 application was deemed complete on October 9, 2007. As of December 13, 2007, a proposed <br />decision to approve the revision application had not been issued. The application was submitted in <br />6 <br />
