III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Unit Train Loadout <br /> A string of empty rail cars was at the unit train loadout but no loading operations were in progress. The <br /> mine ID sign was up at the entrance and surface disturbance markers were up around the site. The <br /> sediment control system was functional. Culverts and ditches had sufficient capacity. The train loadout <br /> bench outslope was well vegetated. There was only snow in Pond J. The pond embankment was <br /> stable and the primary and emergency discharge structures were in place. Pond K had a little wash <br /> down water in it. The pond K embankment was stable and discharge structures were in place. Just <br /> north of pond J, a small pile of coal was laying over the railroad tracks. The operator explained that <br /> one of the coal railcars had spilled part of its load and that the coal was going to be cleaned up. The <br /> area is within the pond J drainage. <br /> The operator had recently added topsoil to the train loadout topsoil stockpile. Some of the topsoil <br /> addition came directly from the Hubbard Creek vent shaft pad construction. The rest of the topsoil <br /> addition came from the Hubbard Creek vent shaft pad construction by way of the Paonia Water <br /> Pollution Control Facility. The topsoil had been transported to the Paonia site and became one of the <br /> subjects of Notice of Violation CV-2007-006. Partial abatement of the NOV was to transport the topsoil <br /> at the Paonia site back to within the Bowie No. 2 permit area. Workers were on site to begin seeding <br /> and applying erosion control matting to the new topsoil stockpile addition. The topsoil stockpile signs <br /> were up on the stockpile. <br /> Records <br /> The records were in compliance, as documented on the following records checklist. <br /> 3 <br />
