111. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Bowie No. 2 Mine, oversighted by the U.S. Office of Surface <br /> Mining. Representing the Colorado Division of Reclamation, Mining and Safety was Joe Dudash. <br /> Representing the Office of Surface Mining was Henry Austin and Christine Belka. Bill Bear <br /> represented Bowie Resources LLC. The mine site was very wet due to a recent precipitation event. <br /> The ground was snow covered at the higher elevations. Longwall mining is currently taking place in <br /> the B-6 longwall panel. <br /> Main Mine <br /> The paved haul road leading to the D-seam portal bench was in good condition. The operator has <br /> finished repaving the road section directly above the B-seam portal bench. The haul road guard rail <br /> and road ditches were in place. The dirt access road leading from the D-seam portal bench up to the <br /> utility bench was in good condition as well. The road berm and ditch were in place. The small slide on <br /> the utility bench outslope appears to have stabilized and will be backfilled soon. There were no <br /> indications of seeps in the hillside above the utility bench access road. <br /> The utility bench was mostly covered in snow. The bench's outside berm was in place. The drainage <br /> ditch and culvert at the rear of the bench had sufficient capacity. The rock catchment berm above the <br /> utility bench was in place and showed no signs of instability. No erosional problems were observed <br /> with the topsoil stockpile on the west side of the utility bench. The mine equipment stored on the utility <br /> bench was well organized. Surface disturbance markers were up along the disturbed area boundary. <br /> The D-seam portal bench was fairly muddy. There was not a lot of coal stockpiled on this bench. No <br /> problems were noted with any of the facilities, including the cap and powder houses. There were no <br /> fuel leaks at the fuel barn. The material storage areas were well organized. Surface disturbance <br /> markers were up. There were no signs of instability with the portal highwall. The bench's outside edge <br /> berm was in place and culverts and ditches in the area had sufficient capacity. <br /> The B-seam portal bench also was muddy. The culverts and ditches in the area were functioning <br /> properly. The bench's cut and fill slopes were stable and the bench berm was in place. A concrete <br /> truck was pouring concrete into a vehicle for transport into the B-seam mine. No problems were noted <br /> with any of the facilities on this bench. Across the haul road, the excess material storage stockpile <br /> appeared to be stable. There was positive drainage off of the stockpile. <br /> Although the main topsoil stockpile was covered in snow, there were no indications of slope instability <br /> or erosional problems. The topsoil signs were up on the stockpile. The mine supplies that were stored <br /> at the adjacent material storage area were well organized. <br /> There was only a small volume of coal that was stockpiled on the coal stockpile bench adjacent to Old <br /> Highway 133. The bench berm was in place, as were the straw bales at the head of the down ditches. <br /> There were no indications of any fugitive coal dust going offsite or coal fines being tracked onto the <br /> main highway. The culverts and ditches near and at the mine site main entrance that direct flow into <br /> pond B had sufficient capacity. The mine ID sign was up at the mine entrance and contained the <br /> required information. Surface disturbance markers were also present around the disturbed area. <br /> 1 <br />
