Box 69 <br />Milner, Colorado 80487 <br />RE: Surface Use Agreement <br />Dear Frank: <br />Attached, please find a signed copy of the above agreement along with Cyprus' check number Ol 12825, in <br />the amount of $250, as payment for the compensation due to you and Ed. <br />On a separate issue, previously we had discussed submitting a letter to the Division of Minerals and <br />Geology indicating that subsiding the creek and part of the bottom land would not cause problems to your <br />operation. 1 advised I would draft up the letter for your signature and will do so, but I need to know the <br />total number of acres of land that you would consider part of the ranch for this area. In the permit <br />application 1 indicated that you own approximately 920 acres in the immediate area, approximately 3,500 <br />acres in T6N, R86W and approximately 1040 acres in T7N, R86W. Also, per our discussion this area is <br />not tlood irrigated nor cropped. The attached letter provides a draft to work from for TCC to submit to the <br />regulatory agency. Forward your comments and I will revise the draft and send it to you for signature. <br />Thanks, in advance for your help on this issue. <br />I was doing some research at the Court House for coal owners in sections 5 and 8 and noted a D. Camilletti <br />and H. Dilargde. H. Dilargde listed the same address as yours and 1 was wondering if this is correct, or if <br />not do you have an address for her?
