ditch above the site, the perimeter surface water collection ditch below the site, and the <br />sedimentation pond has been reclaimed. <br />Items Approved for Permanent Retention <br />The former haul roads on the site and associated culvert and ditches, the constructed drainage <br />across the reclaimed site, and the riprap relief drains off the terrace to the valley floor are <br />permanent features of the reclamation plan. <br />Submittal of Bond Release Application and Completeness Determination by the Division <br />The Division received Eastside's bond release application SL-3 on August 27, 2007. The <br />application was found complete on October 29, 2007, after the Division received proof of <br />publication of the applicant's public notice. The completeness determination was made in <br />accordance with Section 3.03.2(1)(d). <br />Eastside submitted the bond release application following the procedures described in the Act <br />and Regulations. The application also utilized the Division's Guideline Re a~n,>; Selected <br />Coal Mine Bond Release Issues, dated April 18, 1995. <br />Public Notice <br />Eastside published notice of the bond release application in the Glenwood Springs Post <br />Independent once weekly for four consecutive weeks, beginning on August 25, 2007. <br />Eastside also notified landowners within and adjacent to the mine permit area, and other <br />interested parties of the application for bond release, as required by section 3.03.2(1). The <br />Division received no written comments, objections, or requests for an informal conference <br />regarding the bond release application. <br />Bond Release Inspection <br />The Division scheduled and conducted a bond release inspection on October 24, 2007. The <br />site inspection was conducted in accordance with Section 3.03.2(2). Jason Musick and <br />Daniel Hernandez represented the Colorado Division of Reclamation, Mining, and Safety. <br />The operator was represented by Stephen Self of WillowWISP, Inc. (consultant to Eastside <br />Coal Co. Inc.). Warren Roberts, the landowner, was also in attendance. The Division also <br />notified the US Office of Surface Mining, who elected not to attend. <br />III.
