Walker Division DirecTGr <br />subject: Review for Compliance Natural Resource Trustee <br />date: Apri128, 2004 <br />amended May 6, 2004 <br />Rule 4.05.9(17) Alt impoundments shall be examined at least quarterly by a qualified person <br />designated by the operator2 for appearance ofstructural weakness and other hazardous conditions3 <br />The reports shall be retained at or near the mine site°, and a copy of the report shall be submitted to <br />the Division on a quarterly basis, or other approved submittal frequencys. <br />With the exception of inspecting six impoundments (Wash Bay Pond, Taylor Pump Holing Pond, <br />Aeration Pond, North Overflow Pond, South Overtow Pond, and the Sediment f>ump Pond) <br />during the 2"d Quarter, the report demonstrates compliance with this rule. The missing reports <br />were submitted on Apri129, 2004. `The reported dates of inspections are presented in the <br />following table. 2A qualified person (Kurtis Blunt) made the inspections and the report is <br />certified by a registered professional engineer (Jaye Pickart). 3The ponds were inspected for <br />appearances ofstructural weakness, erosion and other hazardous conditions Reports are <br />maintained at the mine site`' as validated by Division of Minerals and Geology (Division) <br />quarterly coal complete inspections at the site. A copy of the report(s) is submitted to the <br />Division on an annual basis (by April 1 following) in the Annual Hydrology Report (AHR) <br />(Permit page 4.05-115). Colowyo was permitted to reduce the frequency of inspection for stock <br />ponds/small depressions on June 5, 2002.
