The Division suggested that further discussion of potential penalties for the pre- <br />1994 NOV be deferred until after the NPDES permit is revised. In this amtext, the <br />Division also suggested deferral on a proposed biological assessment, which H~IC would <br />contract to William Walsh, Ph.D., in order to assess the impact to the ecology below the <br />mine, if any. HMC continues to believe that no environmental damage has been caused by <br />the mine, and that proposed penalties should be dropped in the absena: of such <br />information. HMC further requests that if penalties are not dropped the Division should <br />conduct its own study or allow HMC to conduct a study which scientifically evaluates the <br />stream quality, instead of inferring violations based solely on calculated end-of--pipe <br />discharge limitations. <br />4. HMC discussed its intention of proceeding with the financing;, design, <br />construction, and operation of astate-of-the-art mining and environmental technology <br />gold and silver mine of approximately 250 tons per day ore quantity. Th~: Division <br />indicated that the stormwater and process water permits could be addressed by modifying <br />existing permits. <br />5. HMC officially requested that stormwater and process water permits be ~;ombined. <br />6.
