A groundwater monitoring well had been drilled between sub-azeas 1 and 2-3. To date no water <br />has accumulated in the well. <br />At the end of the second quarter a total of 1,969,593 tons of refuse have been placed on sub-area <br />2-3, a total of 1,365,605 tons of refuse have been placed on sub-area 4, and a total of 299,220 <br />tons of refuse have been placed on sub-area 5-a. <br />A total of twelve compaction tests were perfonmed on sub-area 4 and four compaction tests were <br />performed on sub-azea 5. All of the compaction tests exceeded 90% of Proctor for the refuse <br />material. Sub-azea 2/3 did not have any new compacted lifts to test. <br />Both the topsoil and subsoil piles for these areas have been seeded and are stable. All of these <br />seeded azeas plus the area disturbed during the reclamation ofsub-area 1 show vegetative growth. <br />All organic material and topsoil was removed prior to the storage of refuse in these azeas. <br />Sub-area 1 has been reclaimed and is no longer in use. <br />CERTIFICATION <br />To the best of my knowledge, based on my professional expertise, the permanent refuse structures <br />at the Deserado mine are being constructed in conformance with the pmdent state-of--the-art <br />construction practices as they relate to coal processing waste bank construction. Further, the <br />structures are being constructed in compliance with the approved design, as specified within <br />Section III-20 of the approved permit documents and depicted on Maps 76,77,82 and 83, plus <br />any other referenced maps as they apply to the permit documents. <br />I certify, based on my field observations and those observations of my qualified designates and <br />professional investigations, as detailed above, that the permanent refuse disposal structures at <br />
