Enng <br />date: January 29, 2002 Division Direcbr <br />Dan, I was assigned the task to review the subject Coal Waste Pile Inspection Reports in a file. The <br />file contained reports for the lst, 3`d, and 4t" Quarter 2000. All the reports consist of Northwest <br />Colorado Consultants, Inc. letter reports. This is my review. The file of reports you gave me is <br />returned herewith. <br />Rule 4.10.2 Site Inspection <br />Rule 4.10.2(1) All coal mine waste banks shall be inspected, on behalf of the person conducting <br />surface coal mining operations by a qualified registered engineer, or other qualified professional <br />specialist under the direction of the professional engineer, experienced in construction of similar <br />earth and waste structures, approved by the Division. <br />All of the reports carry the seal and signature of a Colorado registered professional engineer (Brian <br />D. Lsn). <br />Rule 4.10.2(2) Inspection of coal mine waste banks shall be performed in accordance with rule <br />4.09.1(11), and the following additional requirements: <br />Rule 4.09.1(11) Inspection <br />Rule 4.09.1(ll)(a) The fill shall be inspected for stability by a registered engineer or other qualified <br />professional specialist experienced in construction of earth and roclcfill embankments under the <br />direction of a qualified professional engineer at least quarterly throughout the construction and <br />during the following critical construction periods: (1 )removal of all organic material and topsoil, <br />(2)placement of underdrainage systems, (3) installation of surface drainage systems, (4) placement <br />and compaction of fill materials, and (5) revegetation. <br />lst Quarter 2000 <br />The report indicates that the fill was inspected (does not say by who but states "we") on January 4, <br />2000. The report states that there had been no work under the above activities since last fall. The <br />contractor had been stockpiling the waste coal materials in the central portion of Area 1 of [he waste <br />
