Substitute Supply Plan for the <br />I F. Everisl AODr~.pate ration <br />In addition, L.G. Everist owns 39 acre-feet of Green Mountain Reservoir water under along-term <br />contract with the Bureau of Reclamation. Of this 39 acre-feet of water owned, 6 acre-feet have <br />been exchanged with the Denver Water Department for 4.3 acre-feet of storage in Dillon <br />Reservoir. L.G. Everist recently filed an Augmentation Plan in Division 5 Water Court <br />(96C W 176) for the Love Pit operation in which they committed a maximum of 29.05 acre-feet of <br />Green Mountain Reservoir water and 0.29 acre-feet of Dillon water for replacement purposes. <br />Per that plan, the applicant has asked that the remainder of the Green Mountain and Dillon water <br />be allowed for use at other Summit County operations of L.G. Everist. As a result, there is <br />approximately 3.9 acre-feet of Green Mountain and 4.0 acre-feet of Dillon water available for use <br />in this substitute supply plan. <br />The proposed dry-up of historically irrigated acreage will occur from pazcels of land irrigated by <br />the South Rock Creek Ditch, Old Whetstone/Sheep Creek Ditch, and the McKay Ditch. <br />According to Mr. Scori Hummer, the District 36 Water Commissioner, all of these ditches are <br />covered under Senate Document 80. Ditches covered by Senate Document 80 aze protected from <br />calls downstream from Green Mountain Reservoir by reservoir releases. Thus, the ditches are <br />only subject to senior calls between the MCR operation and Green Mountain Reservoir. <br />According to Mr. Hummer, there is rarely a call on this portion of the river. A review of dry year <br />diversion records (1978) show no curtailment of diversions during those yeazs. Specific <br />information for each of these water rights will be discussed below. <br />South Rock Creek Ditch <br />The South Rock Creek Ditch is decreed for 8.0 cfs from South Rock Creek. This ditch diverts <br />water from the upper Rock Creek drainage into the Maryland Creek drainage. A copy of the <br />decree is included as Attachment 3. This right has an appropriation date of July 7, 1935, an <br />adjudication date of October 26, 1937, and an administration number of 31233.00000. <br />881-025.110 Wright Water Engineers, Inc.
