BMRI San Luis Project <br />CDMG Annual Report <br />March 20, 2003 <br />Page 2 <br />and the Telesto survey it appears this discrepancy is primarily associated with certain <br />facilities which previous surveys identified the facility entirely reclaimed, but failed to <br />recognize and delineate features such as access roadways or other area disturbances <br />contained within the reclaimed facility footprint as still requiring final reclamation. <br />Contractual agreements for the demolition, removal and reclamation of the cnrsher/mill <br />facilities were completed with SLV Earthmovers Inc. (SLV) during December 2002. <br />Completion of the contracted crusher/mill demolition and reclamation of the mill area <br />site must be finalized prior to Apri12005 or SLV will forfeit their posted financial surety <br />and BMRI will finalize any uncompleted demolition or reclamation work. <br />Primary roadway surfaces from the Rito Seco county road to the mine equipment parking <br />ditch, as well as the remainder of the South Waste Rock Facility, the mine equipment <br />parking ditch, the mine equipment fuel farm, and the mine equipment parking ditch topsoil <br />stockpile were reclaimed during the fall of 2002. Each of these areas were regraded, <br />topsoiled, seeded with the approved seed mixture and the topsoil material amended with <br />approximately ],800 lbs. of commercial organic fertilizer (i.e., Biosoil Plus). Materials <br />excavated from the geomembrane lined mine equipment fuel farm were tested and managed <br />in accordance with Division recommendations and approval. BMRI retained Terracon of <br />Wheat Ridge, Colorado to sample and characterize these materials. A copy of Terracon's <br />characterization report is attached for the Division's review. <br />Reclamation closure cost estimates were reviewed with the Division during calendar year <br />2001. The existing financial surety was determined to be adequate to complete the <br />remaining surface land reclamation, fulfill surface water and ground water monitoring <br />obligations, and complete water treatment operations associated with the West Pit and Rito <br />Seco alluvial groundwater systems at that time. Since that time, additional reclamation <br />work consisting of 34.96 acres was completed during 2002 reducing the quantity of mine <br />land reclamation required to complete the Project, 127,985,600 gallons {392.8 acre-feet) of <br />West Pit and Rito Seco alluvial ground water was extracted, treated and discharged to Rito <br />Seco Creek in 2002, and since no bond reduction was requested during 2002, the existing <br />financial surety should be adequate to complete the remaining reclamation and closure <br />obligations. Should the Division desire to formally review the bond estimate, BMRI will <br />supply any information necessary. <br />Areas of DisturbanceBeclamation <br />Table 1 below summarizes the San Luis Project areas of disturbance and reclamation. <br />The attached map identifies remaining areas of disturbance. <br />
