Michael J. Boyd - 2 - February 8, 1990
8. The project water requirements identify 1 acre-foot for wash water
requirements. On what basis was this estimate derived?
9. The junior wells are identified as available under an augmentation plan
and the statement is made that other senior rights will be purchased if
necessary. The Division would appreciate a copy of any correspondence on
this matter for our records when this becomes available.
10. The Division received a letter from the Central Colorado Water
Conservancy District on January 2, 1990 which states their well field
will be ruined if mining is allowed. The mining plan says these wells
are abandoned and the CCWCD ditch will be used for discharge during
dewatering. Without agreements with the CCWCD, it appears the Division
must recommend denial of the permit based on Section 115(4)(d) of the
act. What documentation can you provide which demonstrates an agreement
with the operator or these structures will not be adversely affected?
JTD/yjb
cc: Bruce Humphries, ML RD
Steve Renner, ML RD
3984E
