WE <br />Poverty Gulch Project WE <br />CONSENT FOR RIGHT OF ENTRY FOR RECLAMATION ACTIVITIES <br />Tenderfoot Mining Company hereby represents to the State of Colorado, <br />Department of Natural Resources, Mined Land Reclamation Division, that the <br />undersigned is the owner of the following real property located in the County <br />of Teller and the State of Colorado: Mollie Kathleen Lode m.s. #8661 and E1 <br />Dorado Lode m.s.N8068. <br />As such, the undersigned hereby grants to the agents, employees, and <br />contractors of the Mined Land Reclamation Division, Department of Natural <br />Resources, State of Colorado, permission to enter upon such lands to restore, <br />reclaim, abate, control or prevent the adverse effects of past mining <br />practices and to do all things necessary or expedient to protect the public <br />health, safety or general welfare. Such activities are in the public interest. <br />Consent is given to enter upon the above- described property for the length of <br />time necessary to complete the reclamation activity described on the attached <br />"Project Narrative ", subject to the undersigned's continued ownership and use <br />of the property and the prior approval of the lessees' representative, Dennis <br />Lanning. Inactive mine openings are inherently dangerous, unstable and <br />subject to rapidly changing conditions. During the construction phase such <br />changing conditions may make it necessary to safeguard the opening(s) using an <br />appropriate alternative abatement method. <br />In giving consent to this entry, no rights are waived which are conferred by <br />virtue of the language contained in Title IV of the Surface Mining Control and <br />Reclamation Act of 1977, 30 U.S.C. 1231, et. seq. and /or the Colorado Surface <br />Coal Mining Act of 1979, 1973 C.R.S. 34 -33 -133. <br />andowner's signature) <br />Witnessed by <br />(date) <br />JLA /jla <br />2287F <br />Form 8 <br />
