Banta. <br />Division Director <br />The Colorado Inactive Mine Reclamation Program addresses hazards and <br />environmental problems caused by abandoned mines by using grant monies to <br />safeguard hazardous mine openings and reclaim land disturbed by mining. <br />The program is voluntary for landowners, so before we begin any construction we <br />obtain landowners' consent for the work. Most corporate landowners prefer a <br />three -way consent agreement between the landowner, the State, and the <br />contractor who is chosen to do the construction. <br />The three -way consent agreement has been reviewed by the Attorney General's <br />Office and about two years ago, you reviewed the language in the section which <br />specifies insurance requirements, (Section 7.). <br />Now we have a corporate landowner, Pikes Peak Mining Company, who wishes to <br />change the language in Section 7. Due to our limited knowledge of the <br />insurance industry, we thought it prudent to ask you to review the changes <br />before we accept the amended language. <br />I have attached our standard agreement, (Attachment A), and a copy the changed <br />agreement as proposed by Pikes Peak Mining Company, (Attachment B). Section 7, <br />which we would like you to review, is high - lighted in each attachment. We <br />would like to know the following: <br />1) Does the proposed language in Pikes Peak Mining Company's agreement <br />(Attachment B) change our insurance requirements for contractors <br />(as outlined in our standard agreement (Attachment A])? <br />2) Section 7.B. in Pikes Peak Mining Company's agreement (Attachment <br />B) seems to require employer's liability insurance other than <br />Worker's compensation insurance. Is that your interpretation? <br />
