<br />During a combined WFU/DMG inspection of the RP-4 refuse ponds, a series of cracks were noticed <br />parallel to the top of the crest of the embankment. I investigated the cause of these cracks and <br />reported my findings and plan to the division by letter on 6/10/96. The cracks were filled and the <br />entire affected area was re-compacted. A geotechnical services company was contacted to conduct <br />an investigation as to the nature of the cracking and to offer thoughts on the embankment stability. <br />The results of the investigation are expected during August. <br />To the best of my knowledge, based on my professional expertise, the permanent refuse structures <br />at the Deserado mine are being constructed in conformance with the prudent state-of--the-art <br />construction practices as they relate to coal processing waste bank construction. Further, the <br />structures aze being constructed in compliance with the approved design, as specified within Section <br />III-20 of the approved permit documents and depicted on Maps 76,77,82 and 83. <br />I certify, based on my field observations and those observations of my qualified designates and <br />professional investigations, as detailed above, that the permanent refuse disposal structures at <br />Western Fuels-Utah Inc., Deserado Mine, located in Rio Blanco County, Colorado, are being <br />wnstructed in compliance with the design approve as a portion of Permit No. C-018-81, issued by <br />the Colorado Mined Land Reclamation Division. <br />Respectfully, <br />_= _ <br />__ .: William C~ I.~epro, P.E. <br />;, <br />'-_ ' ,~I'~rojest~Ejigineer <br />~`°~Colorado Registered P.E.
