7 <br />these seeded areas plus the area disturbed during the reclamation of sub-area 1 show vegetative <br />growth The topsoil and sub-soil piles along with the pond and other disturbed areas associated with <br />pit Sa that were seeded last fall are showing signs of growth. All organic material and topsoil was <br />removed prior to the storage of refuse in all areas. <br />Sub-area I has been reclaimed and is no longer in use. <br />To the best of my knowledge, based on my professional expertise, the permanent refuse structures <br />at the Deserado mine are being constructed in conformance with the prudent state-of--the-art <br />construction practices as they relate to coal processing waste bank construction. Further, the <br />structures are being constructed incompliance with the approved design, as specified within Section <br />III-20 of the approved permit docttrnents and depicted on Maps 76,77,82 and R3. <br />1 certify, based on my field observations and those observations of my qualified designates and <br />professional investigations, as detailed above, that the permanent refuse disposal structures at <br />Western Fuels-Utah Inc., Deserado Mine, located in Rio Blanco County, Colorado, are being <br />constructed N compliance with the design approve as a portion of Permit No. ('-Ol 8-81, issued by <br />the Colorado Mined Land Reclamation Division. <br />Respectfully, ; 7 <br />/~ f/~ <br />William C.
