Box l77 <br />Silverton, CO 81433 <br />Re: Consent Decree Termination <br />Dear Mr. Perino, <br />OF ~~fO <br />~b_ <br />NQ: <br />l~~O <br />•«~7~*r< <br />Colorado Department <br />of Public Health <br />and Environment <br />February 26, 2003 <br />As you have requested, the Water Quality Control Division has conducted the Permit Termination <br />Assessment, consistent with Section VIII of the Consent Decree and Order in Sunnyside Gold <br />Corporation v. Colorado Water Quality Control Division of the Colorado Department of Public Health <br />and Environment (94 CV 5459). <br />Summary <br />As a result of the Permit Termination Assessment, the Division has concluded that there has been <br />successful Consent Decree Completion. In a separate action, the Division has already released SGC <br />from the financial surety requirement and returned the letter of credit to the Bank. It is appropriate that <br />CDPS Permit Nos. CO-0044768 (the remediation permit) and CO-0036056 (Terry Tunnel permit) be <br />terminated and Court jurisdiction should cease. In addition, in a separate action the Division has <br />transferred CDPS Permit No. CO-0027529 from Sunnyside Gold Corporation to Gold King Mines <br />Corporation. <br />Permit Termination Assessment <br />Paragraph 14 of the original Consent Decree, dated May 8, 1996 and amended on December 6, 2002, <br />contains the Criteria for Successful Pemtit Termination Assessment as follows: <br />14. The Division will determine that there has been a Successful Permit Termination <br />Assessment if all of the following criteria are met: <br />a. Five years have elapsed front the date of valve closure at the American <br />Tunnel property line plug. <br />b. Two years have elapsed since notice of mine pool equilibrium has been <br />given pursuant to Paragraph 9a. <br />c. Valves and pipes in the seals in the American and Terry Tunnels have <br />been grouted. <br />B-8 <br />
