Rule 4.09.1(1 1)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockftll embankments
under the direction of a qualified professional engineer at least quarterly throughout the
construction and during the following critical construction periods: (1)removal of all organic
material and topsoil, (2)placement of underdrainage systems, (3) installation ofsurface drainage
systems, (4) placement and compaction offill materials, and (5) revegetation.
The subject inspection was a quarterly inspection accomplished throughout construction, not one
of the critical construction periods. A registered engineer signed the report.
Rule 4.09.1(11)(b) The qualified registered engineer shall provide to the Division a certified
report within 2 weeks after each inspection that the fill has been constructed as specified in the
design approved by the Division. The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
