Regulations. Please refer to this section for specific requirements relating to Trust Fund type financial
warranties.
Item 5 of Exhibit E states that "Waste rock dumps, tailing impoundments, addits [sic), shafts or
buildings left on site, scale house and truck scale will be removed at the end of operation of the pit
and during final reclamation of the site". Please show the location and configuration of each such
structure on the Mine Plan Map. In the event the applicant does not plan to have any waste rock
dumps, tailing impoundments, adits, or shafts on the site, the application needs to be revised to delete
all references to such features.
Please provide basic dimensional details for any non-portable structures, buildings, and other mining
related facilities that will be associated with the operation. This information is necessary in order to
accurately calculate structural demolition and facilities removal costs. Also, please identify all
structures such as buildings, ponds, ditches, roads, etc, that will be installed during mining and that
are planned to remain on site after completion of final reclamation work,
Item no. 6 of Exhibit E states that "No entry by surface owners or grazing of livestock is to take place
until the bond is released". Since the applicant may not have a legal right to prevent entry by surface
owners onto the surface estate, this phrase needs to be removed from the application. Any safety
concerns the applicant may have with respect to protecting persons and livestock from the safety
hazards associated with an active mining operation can be adequately addressed by alternative means
such as installing warning signs and placing temporary access barriers at appropriate locations.
EXHIBIT F -RECLAMATION PLAN MAP
The map entitled "EXHIBIT F ORION PIT M-94-115 RECLAMATION PLAN MAP" with a map scale
of 1 inch = 1,320 feet needs to be redrawn at an acceptable map scale (not larger than 1 inch equals
50 feet nor smaller than 1 inch = 660 feet). Also, the map needs to be revised to show the expected
physical appearance of the reclaimed affected land, correlated to the proposed mining and reclamation
timetables. The map must show the proposed topography of the area with contour lines of sufficient
detail to portray the direction and slope of all reclaimed lands.
The map entitled "EXHIBITS B, C, & F MINING & RECLAMATION PLAN ORION PIT M-94-115"
is inadequate in the following respects: 1) The map does not identify and outline the full area which
corresponds with the application. Only a portion of the proposed 368 acre permit area is shown on
the map, and the proposed permit area boundary is not clearly delineated; 2) The map does not show
the expected physical appearance of the reclaimed affected land, correlated to the proposed mining
and reclamation timetables; and 3) The map does not show the proposed topography of the area with
contour lines of sufficient detail to portray the direction and slope of all reclaimed lands.
One of the copies of the two maps entitled "EXHIBITS B, C, & F MINING & RECLAMATION PLAN
ORION PIT M-94-115" received by the Division on December 27, 1994 in correspondence from the
applicant dated December 23, 1994 was reduced from it's original size. As such, the map scale
indicated on the title block is no longer accurate. Please revise the map to show the correct scale.
00245
5
