Enclosed is our check in the amount of $275.00. This payment
constitutes the annual fee of $275.00 due June 1, 1980.
Although your letter of June 4, 1981, indicates a fee due for
the past three years (including a fee for 1978/1979), we
respectfully call your attention to the fourth "whereas"
clause in our Development and Extraction Mining Permit (copy
enclosed) which provides as follows:
"WHEREAS, on June 1, 1979, the Mined Land Reclamation
Board accepted surety submitted by Occidental Oil Shale,
Inc. and such date shall be considered the date of
issuance of the permit and the anniversary date for all
other purposes;"
Inasmuch as C.R.S. 1973, 34-32-116 (1)(a) clearly provides
that the payment of the fee, the map and the plan are due on
the anniversary date of the permit, we feel that your request
for a fee for the 1978/1979 year was probably inadvertently
done. Additionally, our 1981 payment was remitted to you with
our 1981 map and plan which was sent under our cover of
March 26, 1981.
The amount of the fee also seems to be a problem. The Logan
Wash facility is an underground mine with modified in situ
production and not an open mining operation. Accordingly, we
believe that the proper fee should be $275.00 per year rather
than $350.00.
