ATTACHMENT A <br />MODIFICATION NUM$ER 18 TO THE REMEDIAL ACTION PLAN <br />Pursuant to Paragraph 20 of the Consent Decree, Order, Judgment and Reference to <br />Special Master entered in State of Colorado v. Idarado Mining Company, (D.C. Colo., <br />No. 83-C-2385 on July 6, 1992 ("Consent Decree"), the Parties agree that the Remedial <br />Action Plan, Appendix I to the Consent Decree ("RAP"), is modified as follows: <br />1. Paragraph 14.1. Reveeetation Establishment Period is modified to read as <br />follows: <br />Idarado will actively maintain the direct revegetation on each tailings pile <br />during an establishment period after the completion of the Scheduled <br />Activity for that tailings pile, in the manner specified in this paragraph. <br />2. In order to allow additional management of the tailings pile vegetation, the <br />following Paragraph 14.1.4 is added to the RAP: <br />14.1.4. Future Growin¢ Seasons. Following the fifth growing season, <br />Idarado may elect to extend the establishment period on individual, <br />several or all of the tailings piles, as appropriate. Idarado's management <br />of the tailings piles for each year shall be pursuant to the management <br />plan submitted to the State as a part of the revegetation and monitoring <br />report specified in ¶ 15.2 below, and will be based on the results of the <br />monitoring conducted pursuant to Section 15.0. The State will review the <br />report and provide Idarado with written approval or disapproval of any <br />proposal for additional management activities no later than 120 days after <br />receipt of the report. If any additional management activities are proposed <br />and approved, Idarado will implement such additional activities during the <br />next summer season after approval of the proposal. During this extended <br />establishment period, Idarado may manage the revegetation by amending <br />and seeding, applying fertilizer, mowing, or applying irrigation water in <br />the manner set forth below: <br />a. Reamendine and Reseeding -Idarado may reamend and reseed <br />individual, several or all of the tailings piles if the results of monitoring, <br />sampling and/or analysis of the revegetated areas conducted by Idarado <br />pursuant to Section I5.0 indicate that such measures are necessary to <br />promote appropriate species diversity and cover. Amendments may <br />include lime, limestone, or organic matter (manure, hay, straw, <br />commercial organic amendment). Idarado will use the seed mix specified <br />for the tailings piles. <br />-4- <br />
