<br />twelve shrubs per acre on the permanent coal waste pile. The permit <br />application does not pin them down to a specific time to plant <br />these woody plants but if they interseed after year 5 it will <br />restart the bond release period. Since there is no specific <br />timeframe to plant this may or may not be an enforcement action. <br />However, it seems that they would want to plant any seedlings <br />during the initial seeding period. <br />In conclusion from the data presented the vegetative cover <br />appears to be established and reasonably diverse with respect to <br />grasses. We will not change the diversity standard to allow one <br />species to comprise more than 40$ of the total cover, especially if <br />it is a cool season species. The concern about the woody plants <br />should be clear with clarification of what is and is not to be <br />considered a woody plant. I have also attached the page out of the <br />permit application which indicates that woody plants are to be <br />transplanted on the reclaimed areas. <br />If you have any questions, please see me. <br />
