If a pattern of tonicity is not demonstrated <br />but a significant level of erratic tonicity is found, the Division may require an incrrased frequency of routine <br />monitoring or some other modified approach. <br />(d) PTl/CIE <br />The results of the PT'I(CfE investigation are to'be received by the Division within 11.0 days o[ the <br />demonstration of atvte WET in the routine test. as defined above, or if accelerated testing is txrfotmed. the <br />date the pattern of toxidty a demonstrated. A stator report is to be arovided to the Division at the 30. 60 <br />and 90 daypoints of the PTVI'IE investigation. The Division may extend the time frame for investigation where <br />reasoaab(e justification exists. A request for an extension must be made is writing and received prior b the 120 day <br />deadlino. Such request must include a justification and supporting data for such ea uteasioa. <br />The permitter may ux the time for investigation b coaduU a PTT or move directly into the TIE. A PTT coasisls of <br />a brief search for possible sours of WSI', which might reveal causes of such tonicity and appropriate corrective <br />actions more simply and cost effectively than a formal TTE. If the PTI allows resolution of the WET incident, the <br />TIE need not necessarily be coaducled. If, however, WET is not identified err resolved during the PTT, the TTE <br />must be conducted within the allowed 120 day tune frame. <br />Aay permitter that is required to conduct a PTI/I'lE investigation shall do so in conformance with procedures <br />identified in the (ollov'iag documents, or as subsegtuatly updated: 1) Methods (or Aouatic Tozicity identification <br />Evaluations. Phase 1 Tozicity Characterization Procodures. EPA/600/6-91/003 Feb. 91 and 2) Methods for Aouatic <br />Tozicity identification Evaluations. Phase II Toxiciri identification Procedures. EPAlG00/3-88/035 Feb. 1989: <br />A third document N this series is Methods for Aouatic Toxicity identification Evaluations. Phase Tii Tozicity <br />Confirmation Procedures. EPA/G00/3-88!036 Feb. 1989. As indicated by the title, this procedure is intended to <br />confirm that the suspected toxicant is truly the bzicaat. This investigation is optional. <br />Within 90 days of the determination of the bzicant or ao later than 210 days after demonstration of bzicity, <br />whichever is sooner, a control program is b be developed and received by the Division. The program shall set <br />down a method and procedure (or elimination of the tonicity b acceptable levels. <br />(e) R_gr, nest For Relief <br />The permittee may request relief from further investigation and testing where the tozirznt has not been determined <br />and the Division has determined suitable treatment does not appear possible. In requesting such relief, the permitter <br />shall submit material sufTicient to establish the following: <br />(i) It has complied with terrors and conditions of the permit compliance schedule for the PITlI1E investigation <br />and other appropriate conditions as may Gave been required by the Division; <br />fir) During the period of the tonicity incident it has ban in compliance with all other permit conditions, <br />including, in the esse o(a POTW, pretreatment requirements; <br />(iii) During the period of the bzicity incident it has properly maintained and operated all facilities and systems <br />of treatment and control; and <br />(iv) Despite the circumstances described in paragraphs (i) and (iii) above, the source and/or cause of tonicity <br />could not be located or resolved. -_ ~ - ~ - <br />-mod! +F r <br />
