could be disturbed at any one time. This amount of land is essentially a floating value that moves around the <br />operation. The limit, ideally, would be maintained by release of reclaimed land so the 60 acre limit defined in <br />the permit is not exceeded. Although there is a great deal of land that has been reclaimed (approximately 55% <br />of the affected land) the amount of disturbance still exceeds the 60 acre limitation contained in the permitted <br />plan. To correct this problem an amendment was determined to be required because the definition of an <br />amendment includes an increase in affected land. It was also determined by the Division that if an affected <br />land boundary had been defined on the permit maps, either specifically or by phasing, then the adjustment in <br />affected land could have been done with a technical revision as has occurred in similar situations on other <br />operations. <br />At the end of this report are two tables that were provided in the technical revision. The technical <br />revision was subsequently withdrawn when it was determined that an amendment was required, but the data <br />provided in that revision is still relevant and useful for inclusion in this annual report. Each disturbance <br />shown on the maps contains an area designation that identifies iu category and number. These designations <br />are indicated in Table 1. <br />Revegetation: Revegetation is showing good progress and good success. The azea planted in 2001 however is <br />showing some weakness due to drought effecu. Much of the land that has been placed in final reclamation is <br />at or very near release capability. It is estimated that neazly 58 acres is potentially ready for release. All land in <br />revegetation status will be examined in May for final determination as to its status with regard to being ready <br />for release. Any land that appears to show sufficient success will be requested for release so as to reduce the <br />amount of affected land within the permit. <br />Bonding: This operation is covered under a self bonding arrangement. As requested by the Division, an <br />interim bond will be provided in the amount of $270,000 prior to submittal of the amendment that will <br />correct the permit deficiency (no affected land boundary) and the affected land limitation. <br />Schmidt Construction 2002 Annual Report M-1988-044 Coal Creek Resources Page 2 of 4 <br />
